Terms and Conditions

The terms and conditions (TOS) described below apply to all use of the Shippable website and all services available through the website. By using the Shippable website and services, you agree to be bound by these terms, so please read this Agreement carefully before using the Shippable website and services.

Shippable has the sole discretion to change or replace any part of this agreement You are responsible for periodically checking this agreement for any changes. Any new Service additions or enhancements are subject to these Terms of Service. You consent to any such changes by continuing to use the Shippable service.

We reserve the right to terminate your account if you violate any of the terms described below.

Account Terms

You are required to sign in to your GitHub account in order to use Shippable. You are solely responsible for maintaining the security of your account and password. You must notify us of any security breach as soon as possible. Shippable will not be liable for any loss or damage if you fail to comply with this security obligation.

Accounts registered by automated methods are not allowed. You must be a real person to use this service.

You are responsible for all activity that happens under your account.

One person or legal entity may not sign up for more than one free trial account.

You may not use the Shippable for any illegal or unauthorized purpose. You must not violate any laws in your jurisdiction in your usage of the Shippable service.

Account Payment

You are billed at the start of each billing cycle and the credit card we have on record for you is charged automatically. Payments are non-refundable, so there will be no refunds for any reason, such as canceling your account or downgrading your plan. Any such changes to your account will be effective on your next billing cycle.

One person or legal entity may not sign up for more than one free trial account.If you upgrade from the free trial to a paid plan, you will be billed immediately since your monthly subscription cycle begins immediately after you upgrade.

For any upgrade or downgrade in plan level, your credit card will be automatically charged the new rate on your next billing cycle.

You may lose content or features if you downgrade your service. Shippable does not accept any liability for such loss.

Account Termination or Cancellation or Termination

You can cancel your account at any time. All your content and profile information will be deleted from the Shippable Service immediately upon cancellation and cannot be recovered once it is deleted.

If you cancel your account before the end of your current billing cycle, you will not be charged after the end of the current billing cycle.

Shippable has the right to suspend or terminate your account with or without cause and with or without notice at any time If your account is terminated, all content and profile information will be immediately deleted and you will no longer have access to your account. Shippable reserves the right to refuse service to anyone for any reason.

Changes to the Shippable Service and Plan Prices

Shippable reserves the right to modify or discontinue, temporarily or permanently, the Shippable Service with or without notice.

Prices and features of all plans are subject to change with 30 days notice from us. We can provide such a notice by posting changes to the Shippable Site or the Shippable Service.

Shippable will not be liable to you or anyone for any modification, price change, suspension or discontinuance of the Shippable Service.

Copyright and Content Ownership

You retain all intellectual property rights over all content in your account. Your profile and any material materials uploaded also remains yours.

Shippable has the right in its sole discretion to refuse or remove any content that is available through the Shippable Service.

General Conditions

The Shippable service is provided on an "as is" and "as available" basis.

Shippable uses third party vendors and hosting partners to provide the hardware, software, networking, storage, and related technology required to run the Shippable Service.

If you choose to use the Shippable website and service, you consent to the transfer and storage of any content and other profile information on servers located in the United States.

We may remove content and accounts containing content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.

You must not transmit any worms or viruses or any content of a destructive nature.

Shippable does not promise that the service will be uninterrupted, timely, secure, or error-free. We make every effort to ensure that it will satisfy your requirements and expectations, but make no promises in this regard.

Shippable cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if the Shippable service was functioning.

The failure of Shippable to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. This Terms of Service supersedes any prior agreements or prior versions of Terms of Service between you and Shippable. You agree that these Terms of Service and your use of the Shippable Service are governed under California law.

If you choose to provide Shippable with your information, you consent to the transfer and storage of that information on our servers located in the United States.
